Insolvency practitioners are regularly faced with appointments to insolvent corporate trustees – trading trusts are a common feature of the Australian business landscape.
In this session, Jennifer will discuss what practical steps a practitioner should take on their appointment, including identifying the extent of trust assets, whether there are multiple trusts concerned and what to do if the corporate trustee has been automatically removed as trustee due to its insolvency. Courts have taken many and varied approaches to the insolvent corporate trustee over the last decade, though the law now appears to be settling. Jennifer will discuss recent cases and current trends in an interactive session.
